J. Dustin Smith

Dustin Smith serves as a Senior Attorney at MDK, specializing in managing an extensive foreclosure portfolio while also overseeing all appellate and complex litigation for the Indiana practice. Since joining MDK in 2015, Dustin has become an integral part of the firm, contributing significantly to its success.

In his day-to-day work, Dustin handles various aspects of the foreclosure process including, but not limited to, reviewing title reports, preparing foreclosure complaints, communicating with clients and borrowers concerning loss mitigation, preparing judgments, attending hearings, reviewing sale documents, and preparing post-sale motions. His adaptability and creative problem-solving skills are his greatest strengths, allowing him to overcome challenges and provide timely results for clients. Whether dealing with pro se borrowers, litigious defense attorneys, or internal processing issues, Dustin consistently finds innovative solutions.

Dustin's commitment to collaboration extends beyond MDK. While he is continuously engaged with members of MDK's Indiana team to refine processes and procedures, he also collaborates with experts outside of MDK to stay informed about industry trends. As he states, "I routinely consult with counsel from outside firms to keep my finger on the pulse of what is happening with other firms in our industry and to learn how they are handling various obstacles in our area of practice."

Outside his legal responsibilities, Dustin is an active member of the Indiana State Bar and has contributed various articles to MDK’s blog, The News Break. Reflecting on his professional aspirations, Dustin emphasizes, "In my professional career, I would like to be known as someone who practiced law the right way – with compassion, a high level of competence, and respect for others."

Dustin's connection with MDK's mission and values is evident in his approach to his work. A cum laude graduate of Valparaiso University School of Law, Dustin's academic achievements include membership in the Law Review and Moot Court.
