Join us in congratulating Dustin Smith and Nick Smith from our Indiana Practice Group on their impressive appellate court victory! Senior Attorney Nick Smith initially argued the case in Indiana state court, which centered on whether a prior foreclosure judgment extinguished our client’s priority mortgage interest due to the lender’s assigned agent not being named.
The state court ruled in favor of our client, granting summary judgment and a decree of foreclosure. The buyer at the prior foreclosure's sheriff sale appealed, but Senior Attorney Dustin Smith skillfully upheld the state court’s decision with a meticulously crafted appellate brief, securing a well-deserved win for our client, MDK, and himself.
Appellate cases, with their complex procedures and tight timelines, can be challenging in a high-volume practice. However, this dynamic duo exemplifies MDK’s mission and values through their outstanding collaboration. Congratulations, Dustin and Nick!
